The most important assets of most small and medium sized companies are not found in their bank accounts, office or production facilities. Today, most such companies only peripherally make hard goods, if at all. In reality, they trade on the minds of the founders and staff. They may sell a service rather than a product. For example, they may design web pages, provide ad copy, arrange for on-line delivery of the latest sports scores or do the thousand and one other tasks that have changed the world in the last ten years. Even when a company develops its own goods, it usually names and designs the product, with the manufacture in a factory owned and run by others. Guards are built into the U.S. Constitution, Federal statutes and the common law to protect these assets. They consist of trademarks and service marks for the protection of the name, logo, packaging and/or product appearance associated with the goods or services; copyrights for the protection of original works (literary, dramatic, musical, pantomimes and choreographic works, pictorial, graphic and sculptural works, motion pictures and other audiovisual works, sound recordings and architectural works); and patents for the protection of inventions and appearance of useful articles.
